THE QUICK READ

At a glance

The OCC has published its GENIUS Act final rule, with a January 18, 2027 effective date. Companion guidance makes licensing transitions and reporting preparations the next practical milestones.

A rulebook with an implementation date

The Office of the Comptroller of the Currency issued its final GENIUS Act rule on October 21, 2026. It takes effect on January 18, 2027, covering payment stablecoin issuers and specified related activities within the agency’s jurisdiction. For the market, the development moves attention from the broad legislative framework toward the operational requirements businesses will need to satisfy. Publication does not mean every issuer has already received approval under that framework. [1]

What the framework covers

The rule addresses reserve assets, redemption, risk management, custody, supervision and capital requirements, among other matters. Its coverage includes qualifying bank subsidiaries, federal nonbank issuers and certain state and foreign issuers. The OCC also identifies an unfinished part of the regulatory work: requirements involving the Bank Secrecy Act, anti-money-laundering controls and sanctions are being handled through separate rulemaking with Treasury. Readers should therefore distinguish this completed rule from the entire implementation process. [1]

Transition requests are a separate decision

Companion guidance explains how an existing issuer with a substantially complete application pending by January 18 may request a waiver. The OCC generally expects to consider relief from the requirement to have prior approval for covered existing issuers, while assessing requests individually. A pending application is consequently different from an automatic exemption. The agency said it would announce when applications and waiver requests open, following approval of the relevant information collection. [2]

Reporting preparations have their own timetable

The same package includes revised weekly and quarterly reporting forms. Those forms remain subject to a further comment process and Office of Management and Budget approval. The stated initial report dates are January 25, 2027 for weekly reporting and March 31, 2027 for quarterly reporting, conditional on that approval. This distinction matters because a finalized operating rule and a proposed information collection are different stages of administrative implementation. [3]

The commercial questions behind compliance

Our interpretation is that the next meaningful comparisons will concern execution: which issuers obtain permissions, how their redemption arrangements operate and how consistently they produce the required information. A recognizable ticker or a widely distributed token does not answer those questions. Businesses considering stablecoin settlement can separately examine the issuer, the intermediary holding the token and the route back to conventional currency. Those are different relationships even when a payment interface makes them look like one service.

What to watch before January

The next checkpoints include the opening of applications, decisions on transition requests and progress on reporting approval. The OCC guidance also describes the information applicants must provide, including their business plans, management, reserves, issuance and redemption processes, and risk controls. These are concrete items against which later announcements can be assessed. Until decisions are published, claims that a particular business is fully approved should be checked against the regulator’s actual records rather than inferred from the existence of the new rule.
